End User Agreement
This End User License (Agreement) applies to your use of all The Paris Apartment, Keys to the Fleas Apps that operate on the IPhone operating system.

Before you launch into using The Paris Apartment, Keys to the Fleas App you need to read and accept this Agreement.

In this Agreement “The Paris Apartment’s, Keys to the Fleas” means The Paris Apartment’s, Keys to the Fleas, “Apple” means Apple Inc and “we” means you and The Paris Apartment’s, Keys to the Fleas.

What about Apple?
Although you purchase your The Paris Apartment’s, Keys to the Fleas through Apple iTunes, we acknowledge that this Agreement is between The Paris Apartment’s, Keys to the Fleas and you, and is not with Apple. The Paris Apartment’s, Keys to the Fleas (not Apple) is solely responsible for The Paris Apartment’s, Keys to the Fleas Apps.

However, we acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of this Agreement. This means that once you have accepted the terms of this Agreement, Apple will have the right and will be deemed to have accepted the right, to enforce the Agreement against you.

How can I use my The Paris Apartment’s, Keys to the Fleas Apps?
You can only use your The Paris Apartment’s, Keys to the Fleas for personal, non-commercial purposes on an Apple –branded product that runs the iPhone operating system software (e.g. iPhone and IPod touch) that you own or control. Your license to all The Paris Apartment’s, Keys to the Fleas is non-transferable and is subject to the Usage Rules set out in the App Store Terms of Service that you have agreed with Apple.

The Paris Apartment’s, Keys to the Fleas owns or licenses all intellectual property rights to The Paris Apartment’s, Keys to the Fleas Apps, including the content in The Paris Apartment’s, Keys to the Fleas and The Paris Apartment’s, Keys to the Fleas trade marks. The Paris Apartment’s, Keys to the Fleas intellectual property may not be used in any way or for any purpose without The Paris Apartment’s, Keys to the Fleas permission.

The Paris Apartment’s, Keys to the Fleas will try our best to make sure that our information is accurate and up to date. However, The Paris Apartment’s, Keys to the Fleas can’t make any guarantees. So, if you are relying on information you receive through a Lonely Planet App, remember to do so at your own risk.

(TPA, Keys to the Fleas) is not responsible to you or anyone for any loss, damage, liability, cost or expense suffered in connection with your use of a TPA’s Keys to the Fleas Application. TPA’s Keys to the Fleas Apps are provided ‘as is’ and TPA’s Keys to the Fleas makes no warranties or representations about TPA’s Keys to the Fleas Apps, or their content. To the maximum extent permitted by law, TPA’s Keys to the Fleas disclaims and excludes any implied warranty of title merchantability or fitness for a particular purpose, and all other warranties or representations of any nature.

Certain laws may imply warranties that TPA’s, Keys to the Fleas cannot exclude or restrict and TPA’s, Keys to the Fleas (not Apple) is solely responsible for those warranties. To the extent permitted, TPA’s Keys to the Fleas liability to you for any claim under those laws is limited to, at its option, the replacement of your TPA, Keys to the Fleas App or the supply of an equivalent product; the repair of your TPA Keys to the Fleas App; the payment of the cost of replacing your TPA, Keys to the Fleas App or of acquiring an equivalent product; or the payment of having your TPA, Keys to the Fleas App repaired.

If your TPA, Keys to the Fleas App does not comply with any applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for TPA, Keys to the Fleas App. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to TPA’s Keys to the Fleas App and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of the Paris Apartment’s, Keys to the Fleas is TPA’s, Keys to the Fleas responsibility.
